- Introduction
- These Terms of Service (“Terms”) govern the relationship between WAC ASSESSORIA EM DOCUMENTAÇÃO E SERVIÇOS DE INFORMÁTICA SOCIEDADE SIMPLES LTDA. (“Service Provider”) and the client (“User”) regarding the provision of electronic visa application and related services.
- By contracting our services, the User declares to have read, understood, and agreed to these Terms, our Privacy Policy, and our Refund Policy. These Terms may be updated at any time without prior notice, becoming effective upon publication.
- Description of Services
- The Service Provider offers the following services:
- Submission of electronic visa applications to the competent foreign authorities, including data collection, form completion, document upload, and payment of visa fees;
- Charging of a fixed service fee (paid to the Service Provider) and the applicable visa fee (paid to the corresponding foreign authority or visa processing outsourced company);
- Optional emergency processing, when travel is scheduled within 30 calendar days from the service request;
- Optional preparation of travel authorization documents for minors, directed to their legal guardians or parents.
- All services are digital in nature and rely on information and documentation provided solely by the User.
- The visa issuance decision is exclusively under the discretion of the destination country’s authorities, which may impose additional requirements or deny a visa application without stating the reasons. The Service Provider has no influence over such decisions.
- The Service Provider offers the following services:
- User Responsibilities
- The User agrees and undertakes to:
- Provide truthful, accurate, and complete personal information and documentation;
- Submit all required documentation in a timely manner, in accordance with the deadlines established by the Service Provider;
- Ensure that all documents meet the quality standards and specifications described in the service instructions (e.g., passport scan resolution, photo size and framing, valid travel reservations);
- Respond within 24 hours to any requests for clarification, correction, or additional documents — especially in emergency service situations;
- Not commit fraud, including falsification of documents, use of altered photos or forged reservations, or presentation of false or misleading information;
- Obtain and hold all necessary legal authorizations from third parties (including other applicants or minors) before submitting their personal data to the platform.
- The User agrees and undertakes to:
- Refund Policy
- Refunds will only be considered when the User cancels the service before the application has been submitted to the relevant authority. Once the application has been filed, no refunds will be issued.
- In any reimbursement, the Service Provider will deduct all non-recoverable fees paid to third parties (such as payment gateways fees, taxes, and currency exchange/processing fees).
- For services involving emergency processing or applications filed within 20 days or less of the User’s travel date, no refund will be issued under any circumstance once the User has confirmed, and the processing has begun.
- Any refund request must be made by email and will be evaluated within 10 business days. Refunds will only be issued to the original payment method used.
- Nature of Service and Limitation of Liability
- The services offered by the Service Provider constitute a service of means (“obrigação de meio”), in which there is no legal obligation of guarantee the desired result. The Service Provider commits to applying all reasonable efforts and diligence to process the User’s visa request but does not guarantee visa issuance, processing times, or acceptance.
- Visa issuance is a sovereign and discretionary decision of the country of destination. Consular authorities have broad discretion to refuse visa issuance without justification or even denial entry during immigration control even for those in possession of a valid visa.
- The Service Provider is not liable for:
- Denials of visa applications by the destination authorities;
- Delays caused by the User, government authorities, or force majeure;
- Any delays, interruptions, failures, or unavailability of the system, website, or communication tools arising from maintenance, updates, internet instability, server overload, third-party service disruptions, or any technical issues beyond its control. The User acknowledges that electronic services are subject to occasional downtime and agrees that such occurrences do not constitute grounds for indemnification or service refund;
- Any financial losses, trip cancellations, or damages suffered due to denied or delayed visa processing;
- Loss or rejection resulting from inaccurate, incomplete, or misleading information or documents provided by the User.
- Data Privacy and LGPD Compliance
- In compliance with Brazilian Data Privacy Law – Lei Geral de Proteção de Dados Pessoais – LGPD (Law No. 13.709/2018), all personal data will be collected and processed solely for visa application purposes.
- The User acknowledges and authorizes the collection and processing of the following data:
- Personal identification (e.g., full name and former names, birth date, sex, passport data, nationalities, marital status, place of birth, address, professional occupation and activities which will be conducted during travel, e-mail and phone number);
- Contact and travel information (e.g., emails, itinerary, accommodation, previous travel history);
- Supporting documents (e.g., financial statements, photos, scanned documents, minor travel authorization).
- The User warrants that they hold authorization to submit data on behalf of any third parties, including co-applicants or minors.
- All data will be retained for the duration of the visa validity, or longer if required by law, and will be safely discarded after that period.
- Intellectual Property
- All website content, software, logos, layouts, trademarks, and documentation are the property of the Service Provider or third parties companies hired to process the information provided by the User, protected by Brazilian and international intellectual property laws. Unauthorized use is prohibited.
- Termination of Services
- The Service Provider reserves the right to suspend or terminate the provision of services, at its sole discretion, in cases of:
- Violation of these Terms;
- Suspicion or evidence of fraud;
- Non-cooperation or repeated failure by the User to provide required documentation or clarifications.
- The Service Provider reserves the right to suspend or terminate the provision of services, at its sole discretion, in cases of:
- Governing Law and Jurisdiction
- These Terms shall be governed by the laws of Brazil, including the Consumer Protection Code (Law No. 8.078/1990) and Brazilian Migration Law (Law No. 13.445/2017).
- Any dispute will be subject to the jurisdiction of the courts of the city where the Service Provider is headquartered, except where another forum is mandated by consumer protection law.
